VOLUNTEER WAIVER: THIS IS AN IMPORTANT LEGAL DOCUMENT. READ CAREFULLY BEFORE SIGNING. YOU WILL BE REQUIRED TO AGREE AND SIGN WHERE INDICATED IN ORDER TO COMPLETE YOUR REGISTRATION. INSERTING YOUR NAME WILL BE DEEMED YOUR ELECTRONIC SIGNATURE AND AN ACKNOWLEDGEMENT TO US THAT YOU HAVE REVIEWED THIS DOCUMENT, UNDERSTAND ITS CONTENTS AND CONSENT TO ITS TERMS.
Release and Waiver of Liability, Assumption of Risk and Indemnity Agreement
In consideration for allowing me, the undersigned, to volunteer, assist, observe, officiate, and/or work at or in connection with the Great Race in Agoura Hills (the “Event”), including travel to and from the Event and any related activities (collectively, the “Volunteer Activities”), I, for myself and on behalf of my spouse, children, guardians, heirs, next of kin, and any legal and personal representatives, executors, administrators, successors and assigns, hereby agree as follows:
Definitions. For purposes of this Agreement, the “Released Parties” include: the City of Agoura Hills, County of Los Angeles, County of Ventura, State of California, the United States of America, the Department of the Interior, and the National Park Service, Las Virgenes Unified School District, Oak Park Unified School District, Los Angeles County Sheriff's Department, Los Angeles County Fire Department, USA Track and Field, Pharmavite LLC, Great Race LLC, and each of their officers, directors, agents, volunteers, employees, sponsors, representatives, affiliates, successors and assigns.
1. Eligibility / Authority to Sign.
I am at least 18 years of age and I am entering into this agreement on my own behalf or I am a parent or guardian and am entering into this agreement on behalf of the minor set forth below.
2. Health and Fitness to Volunteer.
I am in good health and believe I am physically able to volunteer at the Event and perform Volunteer Activities.
3. No Impairment.
I am not under the influence of any medication or substance that would in any way impair my ability to safely perform Volunteer Activities or be present at the Event.
4. Personal Responsibility.
I acknowledge that it is my sole responsibility to determine whether I am sufficiently fit and healthy enough to perform Volunteer Activities and that I am responsible for my own safety and well-being at all times and under all circumstances while at the Event or engaged in Volunteer Activities.
5. Assumption of Risk.
I understand and acknowledge the risks and dangers associated with the Event and Volunteer Activities, including without limitation, the potential for serious bodily injury, sickness and disease (including communicable disease), accidents, permanent disability, paralysis and loss of life; loss of or damage to my equipment/property. I understand and agree that the Released Parties are not responsible for the loss, theft, or damage of any personal property (including vehicles and their contents) that I bring to or leave at the Event or any Event-related location. I further understand the risks include exposure to extreme conditions and circumstances; contact with other participants, spectators, animals, vehicles or other natural or manmade objects; dangers arising from adverse weather conditions; imperfect course or terrain conditions that may vary widely, and that may include uneven and/or slippery surfaces, land, water and surface hazards; equipment failure; inadequate safety measures; negligent rescue operations; participants of varying skill levels; unpredictable spectators or participants; other undefined, not readily foreseeable and presently unknown risks and dangers (“Risks”); natural and man made obstacles including without limitation, vehicles, security barriers, signs, cables, mats, and debris on the course; and the possibility that an Event may be postponed, ended early or cancelled altogether by an Event organizer or governmental officials.
I understand that these Risks may be caused in whole or in part by my own actions or inactions or the actions or inactions of others participating/volunteering in or organizing the Event or others watching, viewing, observing the Event, or the negligent acts or omissions of the Released Parties, and I hereby expressly assume all such Risks and responsibility for any damages, liabilities, losses or expenses which I incur as a result of my Volunteer Activities.
6. Rules and Conduct.
I agree to be familiar with and abide by the rules and regulations established for the Event. I accept sole responsibility for my own conduct and actions while engaged in Volunteer Activities, and the condition and adequacy of my equipment or personal property, if any. I understand that it is the policy of the Event organizers that volunteers are prohibited from wearing headphones during the Event, and use of headphones during the Event could cause me to miss significant information about the Event and my health and safety.
7. Volunteer Status; No Compensation / No Reimbursement.
I am providing volunteer services voluntarily and without wages, salary, or other compensation. I will not be reimbursed for any expenses I incur in connection with the Event or my Volunteer Activities (including travel, mileage, parking, meals, lodging, or supplies). I understand I am not an employee of the Released Parties and am not eligible for workers’ compensation, unemployment benefits, or other employee benefits.
8. Communicable Disease Risk; Health & Safety Rules.
I understand and agree that volunteering at the Event may involve exposure to communicable diseases (including, by way of example, COVID-19, influenza, RSV, norovirus, and other viral or bacterial illnesses). Such exposure may result in illness ranging from mild to severe, and may require testing, medical treatment, isolation, or other restrictions. The Event cannot eliminate or guarantee against the risk of exposure. I voluntarily assume all risks, known and unknown, of illness or injury related to communicable disease arising from or connected to my presence at the Event and/or participation in Volunteer Activities, even if caused in whole or in part by the acts or omissions (including negligence) of the Released Parties, to the fullest extent permitted by law. I agree to follow all Event health and safety rules and any applicable federal, state, and local public health requirements in effect at the time of the Event. I agree not to attend the Event or participate in Volunteer Activities if I: (a) am experiencing symptoms consistent with a communicable illness, (b) have been advised by a medical provider or public health authority to isolate or quarantine, or (c) have a confirmed diagnosis of a communicable illness and have not met the then-current criteria to end isolation/return to normal activities. I understand I am responsible for my own medical costs and that I should carry adequate health insurance.
If I knowingly attend the Event or participate in Volunteer Activities while ill in violation of this Section and that results in claims or losses against the Released Parties, I agree to indemnify, defend, and hold harmless the Released Parties to the fullest extent permitted by law.
9. Weather / Course or Operational Changes.
I understand that the Event will take place in most any weather condition but in case of inclement weather, destructive natural force or fire prior to or at the event, the event organizers, in conjunction with the L.A. County Sheriff's Dept., the City of Agoura Hills and the National Park Service, may choose to close and/or change any or all parts of any course at any time. I understand and acknowledge this may include an alternate route or a course that may not be the same distance and I consent to such changes. I further understand and acknowledge this decision may affect the job in which I am registered and I assume all risks associated therewith.
10. Release, Waiver, Covenant Not to Sue; Indemnity.
I hereby release, waive, and covenant not to sue, and further agree to indemnify, defend, and hold harmless the Released Parties from and against any liability, claims, demands, causes of action, damages, losses, or expenses (including costs and attorneys’ fees) of any kind or nature (collectively, “Liability”) that may arise out of, result from, or relate in any way to my Volunteer Activities and/or my presence at the Event.
THIS RELEASE INCLUDES CLAIMS ARISING FROM THE NEGLIGENCE (INCLUDING NEGLIGENT ACTS OR OMISSIONS) OF THE RELEASED PARTIES, TO THE FULLEST EXTENT PERMITTED BY LAW.
If, despite the terms of this Agreement, I, or anyone on my behalf, makes a claim for Liability against any of the Released Parties, I will indemnify, defend, and hold harmless each of the Released Parties from any such Liability that may be incurred as a result of such claim.
11. Media Release.
I hereby grant the Released Parties and their designees permission to photograph, film, record, and otherwise capture my name, likeness, image, voice, biographic information, and/or volunteer performance in connection with the Event, and to use, reproduce, edit, publish, distribute, and publicly display the same, in whole or in part, for any lawful purpose, including advertising, promotional, marketing, and publicity purposes, without compensation. This permission is worldwide, perpetual, and irrevocable, and applies in any media now known or later developed. I understand that images and recordings of the Event may also be captured by third parties (including news media and spectators), and I waive any claims against the Released Parties arising from such capture or use. I waive any right to inspect or approve any finished product.
12. Medical Treatment Authorization (Adults).
If I require medical attention in connection with the Event, I authorize the Released Parties and/or Event medical personnel to provide or arrange for emergency medical care, treatment, and transportation as deemed necessary in their sole discretion. I understand and agree that I am solely responsible for any and all costs of medical care, treatment, and transportation. I authorize the release of information to medical personnel as reasonably necessary to provide such care.
13. General Provisions (Understanding; Governing Law; Venue; Severability; Accuracy).
I hereby warrant that I have read this agreement carefully, understand its terms and conditions, and acknowledge that I will be giving up significant legal rights by agreeing. This Agreement represents the complete understanding between the parties.
This Agreement shall be governed by the laws of the State of California. Any dispute, claim, or lawsuit arising out of or relating to the Event or this Agreement shall be brought exclusively in the state or federal courts located in Los Angeles County or Ventura County, California, and I consent to the personal jurisdiction of such courts.
If any provision is held to be unlawful, void or for any reason unenforceable, then that provision shall be deemed severable from this agreement and shall not affect the validity and enforceability of any remaining provisions. I certify that all information provided in this form is true and complete, that I am (or that my minor son/daughter/child is) the volunteer who will participate in the event. Electronic signatures will be deemed original signatures. I certify that I am completing the form for myself or I have the legal authority to sign this document on behalf of the Event participant.
IF REGISTRANT IS UNDER AGE 18: Parent/Guardian Consent and Medical Authorization.
This is to certify that I am the legal guardian of the volunteer who is my son/daughter/child and that my son/daughter/child has my permission to volunteer at the Great Race. Further, I certify that my son/daughter/child agrees to be bound to all of the terms and conditions contained in this waiver. I hereby grant race officials my permission to authorize medical treatment for my son/daughter/child if necessary.
