THIS IS AN IMPORTANT LEGAL DOCUMENT. READ CAREFULLY BEFORE SIGNING. YOU WILL BE REQUIRED TO AGREE AND SIGN WHERE INDICATED IN ORDER TO COMPLETE YOUR REGISTRATION. INSERTING YOUR NAME WILL BE DEEMED YOUR ELECTRONIC SIGNATURE AND AN ACKNOWLEDGEMENT TO US THAT YOU HAVE REVIEWED THIS DOCUMENT, UNDERSTAND ITS CONTENTS AND CONSENT TO ITS TERMS.
Release and Waiver of Liability, Assumption of Risk and Indemnity Agreement In consideration for allowing me, the undersigned, to volunteer, observe, officiate, work for, compete or participate in any way in the Great Race in Agoura Hills (the "Event"), the undersigned, for myself, and on behalf of my spouse, children, guardians, heirs and next of kin, and any legal and personal representatives, executors, administrators, successors and assigns, hereby agree as follows:
1. I am at least 18 years of age and I am entering into this agreement on my own behalf or I am a parent or guardian and am entering into this agreement on behalf of the minor set forth below.
2. I am in good health, and have had a licensed physician verify that I am in the proper physical condition to participate in the Event.
3. I am not under the influence of any medication or substance that would in any way impair my ability to safely participate in the Event.
4. I acknowledge that it is my sole responsibility to determine whether I am sufficiently fit and healthy enough to participate in the Event and that I am responsible for my own safety and well-being at all times and under all circumstances while at the Event.
5. I understand and acknowledge the risks and dangers associated with participation in the Event, including without limitation, the potential for serious bodily injury, sickness and disease (including communicable disease), accidents, permanent disability, paralysis and loss of life; loss of or damage to my equipment/property; exposure to extreme conditions and circumstances; contact with other participants, spectators, animals, vehicles or other natural or manmade objects; dangers arising from adverse weather conditions; imperfect course or terrain conditions that may vary widely, and that may include uneven and/or slippery surfaces, land, water and surface hazards; equipment failure; inadequate safety measures; negligent rescue operations; participants of varying skill levels; unpredictable spectators or participants; other undefined, not readily foreseeable and presently unknown risks and dangers (“Risks”); natural and man made obstacles including without limitation, vehicles, security barriers, signs, cables, mats, and debris on the course; and the possibility that an Event may be postponed, ended early or cancelled altogether by an Event organizer or governmental officials (as defined below). I understand that these Risks may be caused in whole or in part by my own actions or inactions or the actions or inactions of others participating/volunteering in or organizing the Event or others watching, viewing, observing the Event, or the negligent acts or omissions of the Released Parties (defined below), and I hereby expressly assume all such Risks and responsibility for any damages, liabilities, losses or expenses which I incur as a result of my volunteer participation in any Event.
6. I agree to be familiar with and abide by the rules and regulations established for the Event. I accept sole responsibility for my own conduct and actions while participating in the Event, and the condition and adequacy of my equipment. I understand that it is the policy of the Event coordinators that volunteers are prohibited from wearing headphones during the Event, and use of headphones during the Event could cause me to miss significant information about the Event and my health and safety.
7. I further acknowledge and agree that an inherent risk of exposure to infectious diseases including but not limited to COVID-19 exists and is beyond the control of Event Organizers. COVID-19 is an extremely contagious disease that can lead to severe illness and death. Event cannot guarantee that I will not become infected with COVID-19 or another infectious disease. According to the Centers for Disease Control and Prevention, senior citizens and individuals with underlying medical conditions are especially vulnerable. By participating in the Event as a volunteer, I knowingly assume all risks, known and unknown, related to exposure to COVID-19. I acknowledge and fully understand both the known and potential dangers of my volunteer participation in the Event and acknowledge and understand that my volunteer participation in the Event, despite Event’s reasonable efforts to mitigate such dangers, may result in exposure to COVID-19, which could result in quarantine requirements, serious illness, disability, and/or death. I agree to adhere to Los Angeles County public health guidelines as well as guidelines and protocols of the Event during my attendance at the Event. I agree not to participate/volunteer in the Event if I have a suspected or diagnosed/confirmed case of COVID-19, if I am exhibiting symptoms of COVID-19 or if I have had exposure to a suspected or confirmed case of COVID-19 within 10 days of Event or if I am subject to any quarantine or similar requirements or have traveled to any state or country that is covered by any travel order within the 10 day period. I agree that I will observe safe, appropriate hygiene during my volunteer participation in all event related activities. I acknowledge and understand that individuals and other participants could initiate legal action against me personally for my volunteer participation or presence in an activity, and that Event organizers will not indemnify, defend or hold harmless me for any and all third party claims, actions, liabilities, losses, costs, claims or settlements related to volunteering for the Event. By signing this Waiver, I acknowledge and understand that I may be found by a court of law to have waived my right to pursue any claims against the Event and Released Parties related to an exposure to COVID-19. I also understand that the Event and Released Parties may seek to pursue or subrogate claims against me if I knowingly participate/volunteer in Event activities following a positive COVID test within 14 days of Event, after being exposed to a person with a positive COVID test, or while exhibiting symptoms of COVID-19. I acknowledge and agree that I have adequate health insurance and sufficient funds to cover my medical care, and that should I become ill or injured in any way due to my volunteer participation in the Event, that I will be solely responsible for my own medical costs and coverage. I further agree to abide by the Center for Disease Control (CDC)'s COVID-19 recommendations for staying safe.
8. I understand that the Event will take place in most any weather condition but in case of inclement weather, destructive natural force or fire prior to or at the event, the event organizers, in conjunction with the L.A. County Sheriff's Dept., the City of Agoura Hills and the National Park Service, may choose to close and/or change any or all parts of any course at any time. I understand and acknowledge this may include an alternate route or a course that may not be the same distance and I consent to such changes. I further understand and acknowledge this decision may affect the job in which I am registered and I assume all risks associated therewith.
9. I hereby release, waive and covenant not to sue, and further agree to indemnify, defend and hold harmless the City of Agoura Hills, County of Los Angeles, County of Ventura, State of California, Las Virgenes Unified School District, Oak Park Unified School District, Los Angeles County Sheriff's Department, Los Angeles County Fire Department, National Park Service, Agoura Hills Community Emergency Response Team, USA Track and Field, Great Race LLC and each of their officers, directors, agents, volunteers, employees, sponsors, representatives, affiliates, successors and assigns (the "Released Parties") with respect to any liability, claims, demands, causes of action, damages, losses or expenses (including costs and attorneys' fees) of any kind or nature (a "Liability") which may arise out of, result from or relate in any way to my participation in the Event, including claims for Liability caused in whole or part by the negligent acts or omissions of the Released Parties. I further agree that if, despite the terms of this Agreement, I, or anyone on my behalf, makes a claim for Liability against any of the Released Parties, I will indemnify, defend and hold harmless each of the Released Parties from any such Liabilities which may be incurred as the result of such claim.
10. I hereby grant the Releasee's permission to use my name, likeness, biographic information, volunteer performance and/or other information relating to my participation in the Event for any purposes whatsoever and to distribute, broadcast and exhibit these without charge, restriction or liability, and I waive all right to any future compensation to which I may otherwise be entitled as a result of such use.
I hereby warrant that I have read this agreement carefully, understand its terms and conditions, and acknowledge that I will be giving up significant legal rights by agreeing. This Agreement represents the complete understanding between the parties. If any provision is held to be unlawful, void or for any reason unenforceable, then that provision shall be deemed severable from this agreement and shall not affect the validity and enforceability of any remaining provisions. I certify that all information provided in this form is true and complete, that I am (or that my minor son/daughter/child is) the volunteer who will participate in the event. Electronic signatures will be deemed original signatures. I certify that I am completing the form for myself or I have the legal authority to sign this document on behalf of the Event participant. IF REGISTRANT IS UNDER AGE 18: This is to certify that I am the legal guardian of the volunteer who is my son/daughter/child and that my son/daughter/child has my permission to volunteer at the Great Race. Further, I certify that my son/daughter/child agrees to be bound to all of the terms and conditions contained in this waiver. I hereby grant race officials my permission to authorize medical treatment for my son/daughter/child if necessary.

USA TRACK & FIELD VOLUNTEER WAIVER AND RELEASE OF LIABILITY, ASSUMPTION OF RISK AND INDEMNITY AGREEMENT
For and in consideration of USA Track & Field, Inc. (“USA Track & Field” or “USATF”) allowing me, the registrant, to volunteer in the USA Track & Field sanctioned event I am registering for herein (the “Event” or “Events”); I, for myself, and on behalf of my spouse, children, guardians, heirs and next of kin, and any legal and personal representatives, executors, administrators, successors and assigns, hereby agree to and make the following contractual representations pursuant to this Waiver and Release of Liability, Assumption of Risk and Indemnity Agreement (the “Agreement”):
1. I hereby represent that (i) I am at least eighteen (18) years of age (or this Agreement is also agreed to by my parent, natural guardian, or legal guardian (the “Guardian”)); (ii) I am in good health and in proper physical condition to volunteer at the Event; and (iii) I am not under the influence of alcohol or any illicit or prescription drugs which would in any way impair my ability to safely serve as a volunteer at the Event. I agree that it is my sole responsibility to determine whether I am sufficiently fit and healthy enough to serve as a volunteer at the Event, that I am responsible for my own safety and well-being at all times and under all circumstances while at the Event site.
2. I understand and acknowledge that serving as a volunteer for track & field, road running, race walking, cross country, mountain, ultra, and trail running Events is inherently dangerous and represents an extreme test of a person’s physical and mental limits. I understand and acknowledge the risks and dangers associated with volunteering at the Event and related activities, including without limitation, the potential for serious bodily injury, sickness and disease, permanent disability, paralysis and loss of life; loss of or damage to equipment/property; exposure to extreme conditions and circumstances; contact with participants, spectators, volunteers, animals or other natural or manmade objects; dangers arising from adverse weather conditions; imperfect course or track conditions; land, water and surface hazards; equipment failure; inadequate safety measures; participants of varying skill levels; situations beyond the immediate control of the Event Organizers (as defined in Section 4 below); and other undefined, not readily foreseeable and presently unknown risks and dangers (“Risks”). I understand that these Risks may be caused in whole or in part by my own actions or inactions or the actions or inactions of others participating in or organizing the Event, and I hereby expressly assume all such Risks and responsibility for any damages, liabilities, losses or expenses which I incur as a result of my volunteer services at any Event, except to the extent caused by the gross negligence and/or willful misconduct of any of the Released Parties (as defined in Section 4 below).
3. I agree to be familiar with and to abide by the Rules and Regulations established for the Event, including but not limited to the Competition Rules adopted by USA Track & Field and any safety regulations established for the benefit of all participants and volunteers. I accept sole responsibility for my own conduct and actions while serving at a volunteer at the Event, and the condition and adequacy of my equipment.
4. I hereby release, waive and covenant not to sue, and further agree to indemnify, defend and hold harmless the following parties, as relevant and applicable in each instance: USATF, its members, clubs, associations, sport disciplines and divisions; United States Olympic Committee (USOC); the event directors, the host organization and the facility, venue and property owners or operators upon which the Event takes place; and any other organizers, promoters, sponsors, advertisers, coaches and officials for this Event; law enforcement agencies and other public entities providing support for the Event; and each of their respective parent, subsidiary and affiliated companies, officers, directors, partners, shareholders, members, agents, employees and volunteers (Individually and collectively, the “Released Parties” or “Event Organizers”), with respect to any liability, claim(s), demand(s), cause(s) of action, damage(s), loss or expense (including court costs and attorneys’ fees) of any kind or nature (“Liability”) which may arise out of, result from, or relate in any way to my participation in the Event, except to the extent caused by the gross negligence and/or willful misconduct of any of the Released Parties. I further agree that if, despite this Agreement, I, or anyone on my behalf, makes a claim for Liability against any of the Released Parties, I will indemnify, defend and hold harmless each of the Released Parties from any such Liabilities which may be incurred as the result of such claim, except to the extent caused by the gross negligence and/or willful misconduct of any of the Released Parties, as relevant and applicable in each instance.
5. As a condition of my participation in the Event, I hereby grant USA Track & Field, the event director and host organization a limited license to use my name, likeness, image, photograph, voice, video, athletic performance, biographical and other information (collectively, “Likeness”), in any media platform or format whatsoever, and to distribute, broadcast and exhibit these without charge, restriction or liability, but only for the purposes of advertising or promoting the Event, USATF, or the sport of Athletics. The foregoing grant, however, does not constitute consent for USATF or any third party to use my Likeness in an endorsement of any product or service without my specific written consent.
I hereby warrant that I (or the Guardian, if I am under the age of 18) am of legal age and competent to enter into this Agreement, that I have read this Agreement carefully, understand its terms and conditions, acknowledge that I will be giving up substantial legal rights by accepting it (including the rights of my spouse, children, guardians, heirs and next of kin, and any legal and personal representatives, executors, administrators, successors and assigns), acknowledge that I have accepted this Agreement without any inducement, assurance or guarantee, and intend for my acceptance to serve as confirmation of my complete and unconditional acceptance of the terms, conditions and provisions of this Agreement. This Agreement represents the complete understanding between the parties regarding these issues and no oral representations, statements or inducements have been made apart from this Agreement. If any provision of this Agreement is held to be unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from this Agreement and shall not affect the validity and enforceability of any remaining provisions.
If the volunteer is under the age of 18, the Guardian hereby agrees to release and discharge the Released Parties as follows: a) The Guardian acknowledges and understands that serving as a volunteer at the Event is inherently dangerous and represents an extreme test of a person’s physical and mental limits. Further, the Guardian acknowledges and understands the Risks, as defined above. b) The Guardian acknowledges the rights waived by both the Guardian and the volunteer by accepting this Agreement. c) The Guardian acknowledges that the Guardian will indemnify the Released Parties from any and all Liability which may arise out of, result from, or relate in any way to the minor serving as a volunteer at the Event, except to the extent caused by the gross negligence and/or willful misconduct of any of the Released Parties.

I hereby release, waive and covenant not to sue, and further agree to indemnify, defend and hold harmless the following parties, as relevant and applicable in each instance: USATF, its members, clubs, associations, sport disciplines and divisions; United States Olympic Committee (USOC); the event directors, the host organization and the facility, venue and property owners or operators upon which the Event takes place; and any other organizers, promoters, sponsors, advertisers, coaches and officials for this Event; law enforcement agencies and other public entities providing support for the Event; and each of their respective parent, subsidiary and affiliated companies, officers, directors, partners, shareholders, members, agents, employees and volunteers (Individually and collectively, the “Released Parties” or “Event Organizers”), with respect to any liability, claim(s), demand(s), cause(s) of action, damage(s), loss or expense (including court costs and attorneys’ fees) of any kind or nature (“Liability”) which may arise out of, result from, or relate in any way to my participation in the Event, except to the extent caused by the gross negligence and/or willful misconduct of any of the Released Parties. I further agree that if, despite this Agreement, I, or anyone on my behalf, makes a claim for Liability against any of the Released Parties, I will indemnify, defend and hold harmless each of the Released Parties from any such Liabilities which may be incurred as the result of such claim, except to the extent caused by the gross negligence and/or willful misconduct of any of the Released Parties, as relevant and applicable in each instance.
5. As a condition of my participation in the Event, I hereby grant USA Track & Field, the event director and host organization a limited license to use my name, likeness, image, photograph, voice, video, athletic performance, biographical and other information (collectively, “Likeness”), in any media platform or format whatsoever, and to distribute, broadcast and exhibit these without charge, restriction or liability, but only for the purposes of advertising or promoting the Event, USATF, or the sport of Athletics. The foregoing grant, however, does not constitute consent for USATF or any third party to use my Likeness in an endorsement of any product or service without my specific written consent.
I hereby warrant that I (or the Guardian, if I am under the age of 18) am of legal age and competent to enter into this Agreement, that I have read this Agreement carefully, understand its terms and conditions, acknowledge that I will be giving up substantial legal rights by accepting it (including the rights of my spouse, children, guardians, heirs and next of kin, and any legal and personal representatives, executors, administrators, successors and assigns), acknowledge that I have accepted this Agreement without any inducement, assurance or guarantee, and intend for my acceptance to serve as confirmation of my complete and unconditional acceptance of the terms, conditions and provisions of this Agreement. This Agreement represents the complete understanding between the parties regarding these issues and no oral representations, statements or inducements have been made apart from this Agreement. If any provision of this Agreement is held to be unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from this Agreement and shall not affect the validity and enforceability of any remaining provisions.
If the volunteer is under the age of 18, the Guardian hereby agrees to release and discharge the Released Parties as follows: a) The Guardian acknowledges and understands that serving as a volunteer at the Event is inherently dangerous and represents an extreme test of a person’s physical and mental limits. Further, the Guardian acknowledges and understands the Risks, as defined above. b) The Guardian acknowledges the rights waived by both the Guardian and the volunteer by accepting this Agreement. c) The Guardian acknowledges that the Guardian will indemnify the Released Parties from any and all Liability which may arise out of, result from, or relate in any way to the minor serving as a volunteer at the Event, except to the extent caused by the gross negligence and/or willful misconduct of any of the Released Parties.
